EITI Multistakeholder Group

Pursuant to Article 1 of the Law of Ukraine “On Ensuring Transparency in the Extractive Industries”, the Multi-Stakeholder Group for EITI Implementation is a permanent body established by the central executive authority responsible for shaping and implementing state policy in the fuel and energy sector, for the purpose of overseeing the process of information disclosure in the extractive industries in accordance with EITI requirements.

The Group includes representatives of central executive authorities, business entities, and civil society organisations.

In line with its assigned mandate, the powers of the Multi-Stakeholder Group include

  • overseeing the process of information disclosure in the extractive industries in accordance with EITI requirements;
  • determining the minimum payment amount below which any payment made by a business entity operating in the extractive industries—whether as a single payment or several related instalments—shall not be included in the report on payments to government and the report on received payments for the relevant reporting period;
  • providing preliminary approval of the forms for the report on payments to government, the consolidated report on payments to government, and the report on received payments;
  • approving the procedure for conducting the selection competition for an Independent Administrator;
  • approving the nomination of the Independent Administrator;
  • providing preliminary approval of the terms of reference for preparation of the EITI Report;
  • approving the EITI Report;
  • deciding that there is no need to prepare an EITI Report in the event of the introduction and approval of the procedure for the functioning of an electronic reporting submission and analysis system;
  • determining the procedure for the functioning of the electronic reporting submission and analysis system (if such a system is introduced);
  • preparing and submitting to the Ministry of Energy materials for the consideration of cases on the imposition of administrative-economic fines for violations of legislation on ensuring transparency in the extractive industries;
  • reviewing proposals submitted by extractive industry disclosure entities aimed at improving the functioning of the extractive industries in terms of regulatory, organisational, technological, material, and other support;
  • developing recommendations on legislative amendments related to the introduction and improvement of mechanisms for the targeted use of funds paid by business entities operating in the extractive industries, in the form of payments, within territorial communities directly affected by extractive activities, approving the Multi-Stakeholder Group’s work plan;
  • approving the action plan for the implementation of EITI provisions in Ukraine;
  • ensuring communication and information exchange with stakeholders who are not members of the Multi-Stakeholder Group;
  • other powers provided for by the Law of Ukraine “On Ensuring Transparency in the Extractive Industries.”

According to paragraph 4 of Section III of the Regulation on the Multi-Stakeholder Group for EITI Implementation, the personal composition of the Group is updated every three years or as needed

Work Plans

Pursuant to Article 8 of the Law of Ukraine “On Ensuring Transparency in the Extractive Industries,” the action plan for the implementation of EITI provisions in Ukraine is approved by the Multi-Stakeholder Group for EITI Implementation.

Article 8 also provides that, to support the work of the Multi-Stakeholder Group, the Ministry of Energy establishes the EITI National Secretariat, which prepares the action plan for the implementation of EITI provisions in Ukraine and organises its implementation following approval by the Multi-Stakeholder Group.

In accordance with the action plan and/or at the request of the Multi-Stakeholder Group, the National Secretariat organises and conducts activities necessary to fulfil the tasks of EITI implementation in Ukraine.
 

Meeting Protocols

Under Section IV of the Regulation on the Multi-Stakeholder Group for EITI Implementation, the Group operates through meetings convened by its Chair as required, but no less than four times a year. An extraordinary meeting may be convened by the Chair at the initiative of at least three members.

Notice of a meeting of the Multi-Stakeholder Group is published on the official Ministry of Energy website no later than five working days before the meeting. The agenda and supporting materials are prepared taking into account the proposals of Group members and sent to them no later than five working days prior to the meeting.

Paragraph 3 of Section IV provides that meetings of the Multi-Stakeholder Group are open.

To participate in a meeting as an observer without voting rights, an applicant must submit a written request specifying the person’s name, the organisation (institution) they represent, and their contact details, addressed to the Chair of the Multi-Stakeholder Group for EITI Implementation, Deputy Minister of Energy Mykola Kolisnyk.
