EITI Standard

The EITI Standard is a voluntary document supported by Ukraine, adopted by the EITI International Board and endorsed by the EITI Global Conference. It defines principles and requirements for ensuring transparency in the extractive industries of oil, gas, and other minerals.

The EITI’s mission is to promote a high level of transparency and openness in the management of natural resource extraction.

At the EITI Global Conference held from June 13 to 16, 2023, in Dakar, Senegal, the new 2023 EITI Standard was presented. Its goals include improving understanding of the energy transition’s impact, combating corruption risks, promoting gender equality, and enhancing revenue collection in nearly 60 implementing countries.

The 2023 Standard is the fourth edition since the first EITI Standard was adopted in 2013.

The EITI Standard is updated every three years.

The changes introduced in the 2023 EITI Standard take effect from January 1, 2025.

On January 29, 2024, the Analytical Center of the NGO “Dixie Group,” with support from the United States Agency for International Development (USAID), conducted an online event titled “Evolution of the Standards: Presentation of the Updated 2023 EITI Standard.” At this event, an Analytical Report was presented that provides a concise description of the changes introduced by the 2023 Standard, analyzes current Ukrainian regulatory acts governing various aspects of extractive companies’ operations and accountability, and offers recommendations on legislative and regulatory amendments to fulfill the requirements of the 2023 EITI Standard.

The 2023 EITI Standard consists of three parts: 1. Implementation of the EITI Standard; 2. Oversight and Validation by the EITI Board; 3. Governance and Management of EITI.

Part 1: Implementation of the 2023 EITI Standard includes the following sections:

1. EITI Principles. Established in 2003 by a coalition of countries, companies, and civil society organizations, these principles aim to improve transparency concerning payments and revenues in the extractive sector.

2. Process for Gaining Implementing Country Status. Any country intending to implement EITI must complete a series of steps before applying for implementing country status.

3. EITI Requirements. The Standard outlines requirements for countries implementing EITI. The national multi-stakeholder group, composed of government, company, and civil society representatives, oversees EITI implementation and sets goals reflecting national priorities in extractive sector governance.

4. Expectations for Supporting Companies. Increased transparency promotes better natural resource governance, strengthens public and corporate governance, reduces corruption, and provides data for greater accountability in extractive industries. Companies supporting EITI collaborate with governments and citizens, benefiting society and local communities.

These companies contribute to EITI implementation by reporting in the countries where they operate and are encouraged to participate actively in multi-stakeholder groups and the EITI process.

5. Protocol: Civil Society Engagement. Contains provisions to ensure full, active, and effective civil society engagement in EITI implementation.

6. EITI Association Code of Conduct. Outlines principles and standards governing the behavior of all EITI officials, including Board members, their deputies, Association members, Secretariat staff (national and international), and members of multi-stakeholder groups.

7.  Open Data Policy. Provides recommendations for adhering to the open data concept in EITI implementation within the agreed scope at the national level. Open data is central to EITI’s mission to promote open and accountable management of natural resources. By making data accessible, understandable, and usable, EITI reporting can enhance public debate, inform decision-making, and foster better public understanding of resource governance.

 

Part 2: Oversight and Validation by the EITI Board

This section describes the procedures and criteria used by the EITI Board to oversee and assess EITI implementation. It includes timelines for implementing countries to publish EITI data and the Board’s supervision of the validation process.

 

Part 3: Governance and Management of EITI

Focuses on governance issues related to the EITI Association.

The primary document prepared in compliance with the international EITI Standard is the annual national EITI Report

In accordance with the Cabinet of Ministers of Ukraine Resolution No. 1098 dated September 30, 2009, “On Ukraine’s Accession to the Extractive Industries Transparency Initiative,” the Government of Ukraine committed to implementing the EITI transparency standard. Ukraine joined the EITI in 2013 and has published annual reports since 2015.

Under EITI requirements, all oil, gas, mining, and other extractive companies making significant payments to the government must provide full and comprehensive information about these payments.

According to the Law of Ukraine No. 2545-VIII dated September 18, 2018, “On Ensuring Transparency in the Extractive Industries,” the EITI Report is prepared by an Independent Administrator based on analysis and reconciliation of information provided by extractive companies and payment recipients, in accordance with the terms of reference and within the EITI framework.

Pursuant to Article 10 of the Law of Ukraine “On Ensuring Transparency in the Extractive Industries,” the Ministry of Energy of Ukraine prepares the terms of reference for the Independent Administrator, who, following approval by the Multi-Stakeholder EITI Group, prepares the annual EITI Report. The content of the terms of reference and the EITI Report must comply with EITI requirements.

The selection of the Independent Administrator and procurement of their services for preparing the EITI Report is conducted in compliance with the Law of Ukraine “On Public Procurement.” The selected Independent Administrator must be approved by the Multi-Stakeholder EITI Group.

The EITI Report is prepared in two languages (Ukrainian and English) and approved by the Multi-Stakeholder EITI Group.
