Government Approves Draft Law on the Implementation of EU Legislation in the Field of Renewable Energy

The Cabinet of Ministers of Ukraine has approved the draft Law of Ukraine “On Amendments to Certain Laws of Ukraine on the Implementation of European Union Legislation in the Field of Renewable Energy Sources.”

The document was developed by the Ministry of Energy of Ukraine in line with the Ukraine Facility Plan and Ukraine’s obligations as a Contracting Party to the Treaty Establishing the Energy Community, as well as to implement EU legislation by bringing the national regulatory framework in the field of renewable energy sources (RES) into compliance with European requirements.

“Ukraine’s membership in the European Union remains an unwavering priority for the Government. The adoption of this draft law will be an important step toward implementing European Union legislation within Chapter 15 ‘Energy’ of the negotiation chapters on Ukraine’s accession to the EU, as well as within the Ukraine Facility Plan,” emphasized Acting Minister of Energy of Ukraine Artem Nekrasov.

The draft law provides for the implementation of EU legislation in the field of renewable energy sources, in particular with regard to:

  • harmonizing national RES terminology with EU terminology;
  • specifics of calculating the share of energy from RES and forming a national target indicator;
  • renewable energy communities and the specifics of their operation;
  • implementation of key principles of permitting procedures for RES projects in accordance with EU legislation;
  • mechanisms for statistical transfers with EU Member States, implementation of joint projects and RES support schemes;
  • specifics of establishing special zones for the development of renewable energy, energy storage installations, and grid infrastructure;
  • clarification of existing legislation regarding sustainability criteria and greenhouse gas emission reductions for biofuels, bioliquids, and biomass fuels.

The adoption of the draft law will enable Ukraine to fulfill its obligations, primarily in the context of preparations for accession to the European Union.
