Deputy Minister of Energy of Ukraine Mykola Kolisnyk took part in the conference “Ukraine-U.S. Minerals Deal: Managing the Risks of Implementation and Potential Disputes”, held within the framework of New York Arbitration Week.
Participants – including the U.S.-Ukraine Business Council (USUBC), representatives of the International Centre for Dispute Resolution of the American Arbitration Association, and the U.S. International Development Finance Corporation (DFC) – discussed priority directions and legal mechanisms for implementing strategic projects in Ukraine, particularly in the field of subsoil use.
Mykola Kolisnyk outlined Ukraine’s legal framework and practical experience in implementing Production Sharing Agreements (PSAs), which investors consider the most secure and predictable legal and economic model for investments in strategic extraction projects.
He noted that the Government of Ukraine has identified a list of minerals that may only be developed under PSAs. This list includes critical minerals and major ore deposits.
The Deputy Minister also emphasized that the Government has already launched two tenders for PSAs involving hydrocarbons within the Mezhyhorivska and Svichanska areas. He called on U.S. partners to participate in these tenders, the outcomes of which will form the basis for issuing the first licenses under the U.S.-Ukraine Investment Fund for Reconstruction.
